Welcome to Eternal K9 (“we,” “us,” “our”). By accessing our website (www.eternalk9academy.com) or using our services, you agree to the following terms and conditions. Please read carefully.

1. Acceptance of Terms

By using our website, enrolling in our services, or signing up for a membership, you agree to comply with these Terms and Conditions and all applicable laws. If you do not agree, please do not use our website or services.

2. Services

Eternal K9 offers the following training and pet care services:

Training Services:

  • Board & Train: Overnight training programs at our facility.

  • Daycare and Train: Daytime training sessions while the dog attends our facility, then returns home.

  • Private Lessons: One-on-one training sessions at our facility or a mutually agreed location.

  • In-Home Immersion: Training at the client’s home, sold as single sessions but often conducted over multiple weeks.

  • Day Training Tune-Ups: Full-day training at our facility with 2–3 training sessions during the day.

  • Virtual Lessons: Video-call training sessions via Zoom or similar platforms; available to any client.

Pet Care Services:

  • Drop-In Visits and Walks: Care and exercise for dogs in the client’s home.

  • Daycare: Supervised care during the day at our facility.

  • Boarding: Overnight care at our facility.

  • House Sitting: Care for pets while clients are away.

Service availability may be limited due to capacity. We reserve the right to modify, suspend, or discontinue any service at any time.

3. Memberships

  • Memberships provide access to online resources, group events, or other benefits as described on the website.

  • Membership fees are billed as outlined during signup. You authorize Eternal K9 to charge the payment method provided.

  • Memberships may include recurring billing. Cancellations or changes to membership require notice as specified in the membership terms.

4. Payments

  • All service fees must be paid in full before services begin unless otherwise agreed.

  • Payments are processed securely via Wix or approved payment processors.

  • Late payments or declined transactions may result in suspension or cancellation of services.

  • Prices are subject to change; current pricing is displayed on the website.

5. Cancellations and Refunds

  • Board & Train, Daycare and Train: Require at least 7 days’ notice for cancellations or rescheduling. In-Home Immersion, Private Lessons, Day Training Tune-Ups, Virtual Lessons: Require at least 48 hours’ notice for cancellations or rescheduling. Deposits for multi-day programs (e.g., Board & Train, In-Home Immersion) are non-refundable.

  • Drop-In Visits and Walks and Daycare: Require at least 48 hours’ notice. Boarding and House Sitting: Require at least 3 days’ notice. Failure to provide notice may result in forfeiture of fees.

  • Memberships: Cancellations must follow the terms specified at signup; no partial refunds will be issued for periods already billed.

6. Client Responsibilities

  • You must provide accurate and up-to-date information about yourself and your dog.

  • Dogs must be current on vaccinations and in suitable health to participate in training or board & train programs.

  • You agree to follow trainer guidance and instructions for the safety and well-being of all participants.

7. Liability and Assumption of Risk

  • Participation in dog training, boarding, or events carries inherent risks.

  • You accept full responsibility for your dog(s) and any injuries, damages, or incidents that may occur.

  • Eternal K9, its employees, and contractors are not liable for indirect, incidental, or consequential damages.

  • You release and hold harmless Eternal K9 from claims arising from participation in services, except in cases of gross negligence.

8. Website Use

  • You may use the website for personal, non-commercial purposes.

  • You agree not to copy, reproduce, distribute, or misuse any content without permission.

  • You may not attempt to disrupt, damage, or interfere with the website or services.

9. Intellectual Property

All content on the website, including text, graphics, images, logos, and digital resources, is the property of Eternal K9 unless otherwise indicated. Unauthorized use is prohibited.

10. Privacy

Your use of our services and website is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

11. Termination

Eternal K9 may terminate or suspend access to services or website privileges at any time, for any reason, including violation of these Terms and Conditions.

12. SMS/Text Messaging Terms

By providing your phone number to Eternal K9, you consent to receive SMS/text messages related to your services, appointments, reminders, updates, or other communications necessary for business operations.

a. Opt-In Consent

You agree that by submitting your phone number through our website forms, service agreements, booking systems, or by communicating with us via SMS, you are providing express written consent to receive text messages from Eternal K9.
Message and data rates may apply.

b. Message Frequency

Message frequency varies based on appointments, services scheduled, or client communication needs.

c. Opt-Out Instructions

You may opt out of SMS/text communications at any time by replying STOP to any message we send.
Once you opt out, you will no longer receive SMS messages except those required for legal, billing, or service-related notices.

d. Data Handling

We may collect and store records of:

  • Your phone number

  • Your opt-in and opt-out status

  • Message delivery history

  • Content of messages exchanged with us

SMS-related data is used solely for service communication and compliance. We do not sell or rent SMS consent data to third parties.

e. Supported Carriers
Carriers are not liable for delayed or undelivered messages.

f. Client Responsibility
You agree to provide an accurate mobile number and update it if it changes.
You acknowledge that SMS delivery may be affected by your mobile carrier or service provider and is not guaranteed.

13. Governing Law

These Terms and Conditions are governed by the laws of the State of Florida, United States, without regard to conflict of laws principles. Any disputes arising shall be resolved in the courts of Bradenton, Florida.

14. Changes to Terms

We may update these Terms and Conditions periodically. Changes will be posted on this page with a “Last Updated” date. Continued use of our website or services constitutes acceptance of the revised terms.
